“One of the nation’s premier DePuy ASR hip recall conferences was held yesterday in Florida,” said Syracuse New York hip recall lawyer Michael A. Bottar, Esq., of Bottar Law, PLLC. “I flew down to attend the confernce,” Bottar said, “and there were no Upstate New York product liability lawyers in attendance. Not one. How can they advertise on Central New York television that they are competent to prosecute DePuy hip cases and not attend the pre-MDL conference put on by the nation’s most experienced defective product lawyers and with input from the nation’s top experts!?”

Many topics were discussed at the plaintiff-lawyer-only conference, including strategy for the law firms that plan to steer the mass tort litigation. The specifics of the conference are confidential and cannot be discussed here. In general, the conference addressed the recall which we reported in blog posts entitled “DePuy Hip Recall Impacts Syracuse, Utica, and Binghamton New York Hip Implant Patients” and “Syracuse DePuy ASR Hip Recall Lawyers Encourage New York Hip Implant Recipients Not To Sign Medical Release.”

“At this juncture, we are focused on evidence preservation. As clients throughout New York request that Bottar Law, PLLC represent them, we are taking steps to protect explanted devices (i.e., devices that have been removed) and to ensure that records are preserved,” Bottar added. “For sure, these claims should not be ‘quick buck’ cases for the TV personal injury lawyers. There is a very real risk of long-term health consequences from exposure to cobalt and chromium and the research is not there yet on, e.g., cancer, chromosomal damage and immune modulation. We are also concerned about metallosis, aspetic lymphocytic vasculitis associated lesions (ALVAL), and pseudotumors. We need some time to develop the medicine.”

The Post-Standard via Syracuse.com reports that a construction worker fell from a steel beam six stories above the ground while working on renovations of the Landmark Theatre last weeek. Fortunately, the man’s fall was arrested by his safety equipment, but he was forced to dangle at the end of an 8 foot harness for over an hour while waiting to be rescued. The accident occurred during the demolition portion of the renovation, when a large piece of concrete pinned the worker’s safety line to the beam. During the rescue effort, a co-worker first attached a second safety line, then he and local firefighters were able to lower the worker to the ground with a cherry-picker. The man was eventually taken to the hospital with minor injuries.

Construction accidents like these happen far more often than you would think, and while the worker in this case escaped unharmed, in many other instances the victims are not nearly so lucky. Such mishaps can result in serious injuries, including chronic pains, loss of a limb, paraplegia, and even death. Safety harnesses, hard hats, and other safety protocols are put in place to prevent such injuries at construction sites, but accidents still inevitably occur. If you were injured on the job, it is in your best interest to speak with a Syracuse New York construction accident attorney immediately. A trained lawyer can apprise you of your rights and help you pursue a course of action in your best interests.

A recent Associated Press news story on CNYcentral.com reports that Boncheff Greenhouses Inc. sold several batches of herbs that may have been contaminated by salmonella. The Canadian company, based in Toronto, may have distributed tainted cilantro, curly parsley, and flat leaf Italian parsley through multiple grocery market chains in several New York municipalities, as well as Erie, Pennsylvania. The herbs were sold during the last two weeks in December of 2010, and Boncheff has offered refunds for customers who return any of the affected packages to their place of purchase. Thankfully, there have been no reported cases of salmonella linked to the herbs.

The threat of salmonella is very real, and while the illness is hazardous to adults, it can be fatal both for children and those with depleted immune systems. Unfortunately, the presence of salmonella has not been removed from all the food we buy from our local grocer, and this news story serves as a reminder that contaminated food makes its way onto store shelves despite the best efforts of companies and regulatory agencies. While you cannot control whether or not you get sick from a defective or contaminated product, you can control what you do if you are sickened or injured. A skilled Syracuse product liability attorney can assess the merits of your foodborne illness case and determine the best course of action. Not every case is compensable under the law, but speaking with a lawyer is the only way to find out if you have any legal recourse.

The US Consumer Product Safety Commission (CPSC) and Wal-Mart have recently issued a voluntary recall of the Flow Pro, Airtech, Aloha Breeze, and Comfort Essentials 1500 watt electric heaters sold by the retail chain from 2001 – 2009. The CPSC reports that the recall is for approximately 2.2 million heaters that may malfunction in a way that can cause overheating, smoking, burning, melting, and fire. Twenty-one incidents total were reported, with four reported injuries caused by burns and smoke inhalation. While this is a voluntary recall, the CPSC advises that all customers stop use of the heater immediately and take them back to any Wal-Mart store to receive a refund.

A story by the Associated Press on Syracuse.com reports that Chrysler and Volkswagen have announced recalls for several vehicles in response to accidental air bag deployments and possible fuel leak issues. The Chrysler models in question are 2008 model year Town and Country and Dodge Caravan minivans, and the issue is a water leak from the air conditioner drain that may cause unintended air bag deployment. The company reports that over 367,000 vehicles are included in the recall after receiving thirty complaints and five reported injuries due to the issue.

Volkswagen has issued a recall of over 228,000 Golfs, Jettas, Rabbits, and New Beetles built from 2006 – 2010, depending upon the model. The company stated that a plastic tab located on the windshield wiper fluid reservoir may chafe a nearby fuel line and create a leak that could pose a risk of fire in the Golfs, Jettas, and Rabbits in question. The New Beetles have a similar issue caused by a fastening clamp on a power steering hydraulic fluid hose. Unlike the vehicles involved in the Chrysler recall, there have been no reported injuries from Volkswagen’s fuel leak issues.

If you or someone close to you has been injured by one of the cars mentioned above, it is in your interest to consult with a New York product liability and car recall lawyer as soon as possible. An attorney can evaluate the circumstances of your case and determine the viability of your legal claims. Should you have such a claim, a lawyer may be able to help you secure compensation for the injuries you have suffered.

As most football fans are aware, this past weekend, the roof of the Minneapolis Metrodome collapsed on Sunday afternoon. The Associated Press reports that the collapse occurred during a snowstorm caused by winter weather that has affected much of the Midwestern United States over the past several days. The inflatable roof of the Metrodome collapsed after seventeen inches of snow fell on Minneapolis on Saturday and Sunday. Thankfully, no one was injured when the incident occurred. The collapse is the second roof failure that the Metrodome has endured since its construction in 1982.

The Metrodome roof failure is getting plenty of media coverage due to its impact on America’s most popular sport, but Bottar Law is always researching and tracking structural failures that occur in lower profile circumstances. Engineering and architectural malpractice is more common than most think, and many people are injured every year as a result of negligent building design and construction. Structural failures usually result in significant property damage and the victims who are hurt by those failures can suffer severe and lifelong injuries.

If you or someone you know has been the victim of architectural negligence or an engineering error, seeking the aid of a legal professional is advisable. A New York engineering and architectural malpractice attorney can evaluate your case, provide legal counsel, and formulate a course of action that can help get you compensated for your injuries. Not all victims are entitled to legal relief, but a lawyer can inform you of your rights after an accident and help get you on the road to recovery.

For many, the winter holiday season means family gatherings and, as a result, the season also means increased traffic on New York State roadways. An increase in automobile traffic, as well as commercial vehicles used to transport presents and merchandise this time of year, can cause the State’s highways and byways become more crowded and, in turn, more dangerous to travel. We here at Bottar Law, PLLC want to wish everyone a happy holidays and take this opportunity to ask our readers to be careful when driving to see loved ones this year, because winter weather and increased traffic can be a dangerous mix.

The Post-Standard reports that a major accident occurred yesterday on the New York State Thruway in Van Buren. After an initial investigation, the New York State police found that a semi-truck jackknifed near Exit 39 on the Thruway on December 7th and blocked all of the westbound traffic. Within moments, a second and third trailer collided with the first truck, setting fire to one big rig. Two of the drivers were injured and taken to the hospital after law enforcement arrived at the scene, and thankfully neither driver sustained life-threatening injuries.

This news story illustrates how dangerous driving amongst tractor-trailers can be, and serves as a warning to drivers everywhere. Because of their size, semi-trucks can do serious damage to other motorists, and accidents often occur due to driver negligence. If you or someone you know was injured in an accident with a tractor-trailer, you should contact a New York truck accident attorney immediately The aid of an experienced lawyer can be invaluable in getting you compensated for your injuries.

Bridge and roadway defects and failures have received extensive media coverage recently both in New York and across the country due to the Syracuse bus accident that occurred in Onondaga this past September. More information about this accident can be found in previous posts here on the Syracuse Injury Lawyer Blog. Bottar Law, PLLC is saddened by this accident and is anxious to help the victims of the bus crash with their legal claims stemming from the preventable crash. Our attorneys are currently investigating the circumstances of the accident for the benefit of our clients. In the course of this investigation, we discovered that the New York State Department of Transportation is taking significant action to make New York’s roads and bridges safer for those who use them.

According to an Associated Press story on Syracuse.com, the DOT plans to spend almost 3.5 billion dollars on fixing and replacing almost four hundred bridges in the state. The renovations are needed because New York’s over seventeen thousand bridges have been in service for an average of forty-six years, and their continued operation is crucial to the state’s transportation infrastructure. The DOT inspects every bridge at least once every two years and knows that the need for more bridgework will only increase as time goes on.

While the DOT does its job well, no administrative body is perfect. Because of that infallibility, people are injured on New York’s roadways every year. As experienced bridge and roadway failure attorneys, Bottar Law, PLLC is pleased to see that the state of New York is spending the money to keep our roads safe. However, if you were injured while driving because of engineering or architectural negligence, you should contact a Syracuse accident attorney as soon as possible to learn about your rights.
